General Conditions of Sale

1 - COMPLETENESS
These general terms and conditions express the entirety of the obligations of the parties. In this sense, the consumer is deemed to accept without reservation the entirety of the provisions provided for in these general terms and conditions. No general or specific conditions appearing in the documents sent or delivered by the consumer may not be incorporated into these terms and conditions, since these documents would be incompatible with these general conditions.

2 - PRODUCTS
Each product offered on the site http://www.lilygarden.fr/fr/ is accompanied by a descriptive text and one or more photos allowing the potential customer to know before the final order, the essential characteristics of the product. However, the information, characteristics, photographs and graphics presented on the site or in the emails sent by Lily Garden are given for information purposes only. In particular, the difference in perception of shapes and colors between the photographs or graphics presented and the products cannot engage the responsibility of Lily Garden. However, Lily Garden will endeavor to represent and describe as faithfully as possible the products sold on its site.
If the Customer transmits a personal motif or personalizes the product by adding a text, he assures lilygarden.fr that the text and/or the chosen motif are free from third-party rights. In the event of any violations of copyright, personality or law, these are the sole responsibility of the Customer and he alone will assume any possible legal consequences.

If Lily Garden were to be prosecuted on this count, the customer undertakes to indemnify Lily Garden against any conviction that may result. The Customer also ensures that he does not infringe any other third-party rights by individualizing the Product.

3 – ORDER TERMS
Taking an order on the Site is subject to compliance with the procedure set up by Lily Garden on the Site comprising successive stages leading to validation of the Order.
In order to place an order, the Customer agrees to communicate via the Site only the real and valid information necessary for the execution of the service covered by these General Terms and Conditions. The Seller cannot be held responsible for incorrect information transmitted by the Customer resulting in the non-execution of the service covered by these General Terms and Conditions. The Customer may access and modify their data at any time in the "my account" section.
Any order will only be deemed validated after acceptance of payment. The Seller will be entitled to refuse or cancel any order relating to a Customer in dispute over a previous order.
Orders are accepted within the limits of available stocks. The permanent or temporary unavailability of a product may not in any case engage the responsibility of the Seller and may not entitle the Customer to compensation or damages. After validation of the order by the Seller, the Customer receives a confirmation by e-mail.
The customer can select as many Products as he wishes which will be added to the basket. The basket summarizes the products chosen by the Customer as well as the prices and associated costs. The customer can freely modify the basket before validating his order. Validation of the Order constitutes confirmation of the customer's acceptance of the General Terms and Conditions, the products purchased, their price and the associated costs. A confirmation email summarizing the order (products, price, availability of products, quantity) will be sent to the customer by lilygarden.fr.
For this purpose, the Customer formally accepts the use of electronic mail for confirmation by Lily Garden of the content of his order.

4 – PRICE AND PAYMENT TERMS
The prices displayed on the site are expressed in euros excluding shipping costs.
Packaging costs are indicated before validation of the order.
The seller may modify the prices of the products at any time and without notice, in particular due to changes in the economic, legislative and fiscal framework. The products are invoiced on the basis of the rate in force at the time of validation of the order.
The products remain the full and entire property of Lily Garden until full payment of the price of each order by Lily Garden.

Payment for purchases can be made via the secure platform of our partner Société Générale, via Paypal or by check. The Customer expressly acknowledges that the communication of his bank card number to Lily Garden constitutes authorization to debit his account up to the price of the products ordered.
The data recorded and stored by Lily Garden constitutes proof of the order and all past sales. The data recorded by the Société Générale payment platform constitutes proof of any financial transaction between the Customer and Lily Garden.
For delivery outside the European Union, the Customer must pay customs duties or other taxes due on the occasion of the importation of the products into the country of the place of delivery. The formalities relating thereto are also the exclusive responsibility of the Customer.
The Customer is solely responsible for verifying the possibilities of importing the products ordered with regard to the rights of the territory of the country of delivery.

5 - DELIVERIES
In accordance with the provisions of article L 121-20-3 of the Consumer Code, the products ordered are sent by tracked letter, the tracking number is communicated to you when the package has been posted.
Lily Garden will do its best to ensure that each order is shipped within 24 to 48 hours, this period may be extended to a maximum of 5 working days (in particular for the shipping of "Glitter Bubbles" which take longer to make). If you have deadlines, do not hesitate to let us know when you order and we will try to speed up the shipping process. However, Lily Garden cannot be held responsible for postal delays.
For delivery to countries outside Europe, any import taxes are entirely the responsibility of the recipient.

6 – RIGHT OF WITHDRAWAL AND RETURN TERMS
In the event that the Customer is not satisfied with the products, he/she can obtain a refund for a piece of jewelry purchased on the e-shop, or exchange it. He/she has 14 days to do so, from the date of receipt of his/her order. Each returned piece of jewelry must be in its original packaging, without having been worn. However, the right of withdrawal cannot apply in the context of the acquisition of products benefiting from the rates and advantages of Private Sales (e.g.: jewelry offered for the purchase of two pieces of jewelry, one of the two pieces of jewelry cannot be refunded without the return of the free piece of jewelry).

Lily Garden will also not be able to refund or exchange any item that has been worn, or shows signs of wear.

The shipping costs associated with returning products remain the responsibility of the customer unless the product received is not compliant or has a manufacturing defect.
Any customs charges related to the return of a product from a foreign country are also the responsibility of the customer.
It is recommended that you obtain proof of this return, which assumes that the products are returned with parcel tracking.
Upon receipt, and subject to these return conditions, the seller will refund the order excluding initial shipping costs by transfer to the customer's bank account after receipt of the package and within 30 days of receipt of the customer's bank details.
Regarding returns of personalized products: Article L121-20-2 of the Consumer Code provides that "the right of withdrawal cannot be exercised for contracts for the supply of goods made to the consumer's specifications or clearly personalized". However, we undertake to reimburse you for clearly personalized products that do not correspond to your order (defective or non-compliant).

7 - GUARANTEES
Lily Garden jewelry is guaranteed for one year. It is available in gold-plated brass or coated with bronze and varnish.

They are fine and delicate and require careful use. Natural gemstones may vary in color and shape.
To ensure optimal longevity for your jewelry, we advise you to avoid direct contact with water or perfume.
If these return conditions are not respected, the package will be returned to the customer at their expense and will not result in any refund.
The following are excluded from any warranty:
– Improper use and maintenance as well as faults in use or maintenance.
– Damage due to handling error, improper or abnormal use, intentional or accidental physical modification, use for professional or commercial purposes.
– Damage due to an external event (lightning, water damage, etc.).
– Interventions carried out on the jewel by any person not authorized by the After-Sales Service as well as deterioration resulting from such intervention.

8 – LEGAL INFORMATION
Personal information relating to the customer is essential for processing and delivering orders. Lily Garden undertakes not to communicate, free of charge or for compensation, the contact details of its customers to a third party. In accordance with the "Data Protection" law of 6 January 1978, amended in 2004, you have the right to access, rectify and oppose information concerning you. 9 – INTELLECTUAL PROPERTY
The Customer acknowledges that the Lily Garden Products and distinctive signs (image, photographs, packaging, product names, etc.) are the exclusive property of Lily Garden.

The Customer shall refrain from any act of reproduction or use of product models, packaging, brands or distinctive signs, inventions, techniques or know-how used by Lily Garden, as well as any act tending to the appropriation of these elements, whether or not they are protected by Lily Garden by a patent, trademark, registered design or copyright.

10 – APPLICABLE RIGHTS, LANGUAGES AND DISPUTES
These General Terms and Conditions of Sale apply to products sold on the site http://lilygarden.fr operated and put online by the Lily Garden Company. All orders on the Site are subject to these General Terms and Conditions of Sale. These are subject to modifications and updates, the conditions applicable to the order of a product by a Customer are those in force on the day of the order.

These General Conditions and accepted orders are subject to French law.
The language of these General Conditions and of accepted orders is French.
In the event of a dispute, the French courts will have sole jurisdiction.
